A Guardianship offers the prospect of appointing a trusted individual to make decisions in numerous aspects of a person’s life such as medical, education, and residential decisions.

A Conservatorship, on the other hand, is geared specifically towards financial decisions, such as managing assets and investments, paying bills on the person’s behalf, and much more.

People usually petition the court for guardianship or conservatorship when a loved one becomes incapacitated, whether it’s because of a disability, an accident, or an illness such as Alzheimer’s or dementia. Guardianships and/or conservatorships may also become necessary in the case of a special needs child who reaches adulthood but still needs their parents or another loved one to make important decisions on their behalf. In these cases, the person cannot make decisions about their own healthcare and the management of their estate, and so the court must appoint someone to make decisions that are in their best interest.
